  3. YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE 
  4. AGREEMENT BEFORE INSTALLING THIS SOFTWARE PROGRAM. BY 
  5. INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE 
  6. PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS OF THIS 
  7. AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS 
  8. AGREEMENT, PROMPTLY DELETE THE SOFTWARE FILES FROM YOUR 
  9. COMPUTER.  CONSULT YOUR COMPUTER OR OPERATING SYSTEM 
  10. USER MANUAL FOR INSTRUCTIONS ON HOW TO DELETE THE 
  11. SOFTWARE IF YOU DO NOT KNOW HOW TO DO SO.

  13. This software program (the "Program"), any printed materials, any on-line or 
  14. electronic documentation, and any and all copies and derivative works of such 
  15. software program and materials are the copyrighted work of Peretek.com or its 
  16. suppliers.  All use of the Program is governed by the terms of the End User 
  17. License Agreement which is provided below ("License Agreement"). The Program is
  18. solely for use by end users according to the terms of the License Agreement. 
  19. Any use, reproduction or redistribution of the Program not in accordance with 
  20. the terms of the License Agreement is expressly prohibited.

  23. END USER LICENSE AGREEMENT

  25.    1. Limited Use License. Peretek, Inc. ("Peretek") hereby grants, and by 
  26.          installing the Program you thereby accept, a limited, non-exclusive 
  27.          license and right to install and use the Program for your use on 
  28.          any computer you have the legal rights to modify and use.
  29.  
  30.    2. Ownership. All title, ownership rights and intellectual property rights 
  31.       in and to the Program and any and all copies thereof (including but not 
  32.       limited to any titles, computer code, objects, artwork, animations, 
  33.       sounds, methods of operation, moral rights, any related documentation, 
  34.       are owned by Peretek. The Program is protected by the copyright laws of 
  35.       the United States, international copyright treaties and conventions and 
  36.       other laws. All rights are reserved. If the Program contains certain 
  37.       licensed materials, Peretek's licensors may protect their rights in the 
  38.       event of any violation of this Agreement.

  40.    3. Responsibilities of End User.
  41.  
  42.       A. Subject to the Grant of License herein, you may redistribute, 
  43.          free of charge to the receiver, copies of the Program and its related
  44.          documentation.  You may not reverse engineer or modify the binary
  45.          source of this program and redistribute it under its current name.
  46.          If you change the Programs files in any way, you must ensure that 
  47.          those changes and the names of those who made the changes are
  48.          distributed with the Program.

  50.       B. You are entitled to use the Program for your own use, in any way
  51.          you deem appropriate.

  53.    4. Limited Warranty. Peretek expressly disclaims any warranty for 
  54.       the Program and its documentation. The Program and documentation 
  55.       are provided "as is" without warranty of any kind, either express 
  56.       or implied, including, without limitation, the implied warranties 
  57.       of merchantability, fitness for a particular purpose, or 
  58.       noninfringement. The entire risk arising out of use or performance 
  59.       of the Program and documentation remains with the User.

  61.    8. Limitation of Liability. PERETEK, INC. SHALL NOT BE LIABLE 
  62.          IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM 
  63.          THE USE OF THE PROGRAM INCLUDING, BUT NOT LIMITED TO, 
  64.          LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR 
  65.          MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL OR PRIVATE 
  66.          DAMAGES OR LOSSES.

  68. I hereby acknowledge that I have read and understand the foregoing License 
  69. Agreement and agree that the action of installing the Program is an 
  70. acknowledgment of my agreement to be bound by the terms and conditions of 
  71. the License Agreement contained herein. I also acknowledge and agree that 
  72. this License Agreement is the complete and exclusive statement of the 
  73. agreement between Peretek, Inc. and me, and that the License Agreement 
  74. supersedes any prior or contemporaneous agreement, either oral or written, 
  75. and any other communications between Peretek, Inc. and me.
